About AIRE

AIRE is an AI-powered real estate platform that is designed to replace many functions traditionally performed by real estate agents. The Platform helps Users list, market, negotiate, and manage real estate transactions with AI-driven guidance and automation throughout the process. As part of delivering these services, we process personal data about Sellers, Buyers, and other users of the Platform.

Scope

This Privacy Policy applies to personal data we collect when you visit or use the AIRE web application, when you participate in our beta program, and when you use the Platform as a Seller, Buyer, or other user, including professionals who may be referred through or interact with the Platform. It also applies to related communications and interactions with AIRE in connection with your use of the Platform.

Relationship to Terms of Service and Beta Terms

This Privacy Policy is incorporated by reference into, and should be read together with, AIRE's Terms & Conditions and any applicable beta program terms or promotional terms (such as the Beta Launch Special). Capitalized terms used but not defined in this Privacy Policy have the meanings given to them in the Terms & Conditions. In the event of a conflict between this Privacy Policy and other terms governing your use of the Platform with respect to privacy matters, this Privacy Policy will control to the extent permitted by applicable law.

2. Data Controller and Contact Information

Identity of the Data Controller / Brokerage Entity

The AIRE platform is provided by AIRE LLC ("AIRE"), which is generally responsible for determining how and why personal data is processed in connection with your use of the Platform. In some cases, where required by local law or brokerage regulations, another affiliated brokerage entity may act as the data controller or co-controller for specific services or transactions.

AIRE LLC ("AIRE") is organized as a Florida limited liability company and operates the AIRE platform from the United States. Our principal business address is 150 SE 25th Rd 14C, Miami, FL 33129. The specific AIRE entity and governing jurisdiction for your use of the Platform are set out in the Terms & Conditions, listing agreements, and other contracts that you may enter into with us.

3. Categories of Personal Data We Collect

We collect different types of personal data depending on how you use the Platform (for example, as a Seller, Buyer, or other user interacting with our AI tools, MLS integrations, and transaction workflows). These categories include:

Account and Identity Information

This includes details you provide when creating or managing your account, such as your name, contact information (including email address and phone number), and account credentials or authentication details.

Property and Listing Information

This includes information about properties you list or manage through the Platform, such as property addresses, physical characteristics and features, photos and media, pricing and financial information, and identifiers such as MLS IDs or internal listing IDs.

Transaction and Contract Information

This includes information generated as part of a real estate transaction, such as offers and counter-offers, contract terms and contingencies, closing documents, and signatures (including electronic signatures collected through integrated e-sign providers).

Usage and Interaction Data

We collect information about how you interact with the Platform, including actions you take in the app (such as steps completed in listing or application forms, checkboxes and acknowledgments you select, and navigation patterns within dashboards and workflows). We may also maintain communication logs and messages exchanged through the Platform between Buyers, Sellers, and other participants in a transaction.

Device and Technical Data

We automatically collect certain technical information when you access or use the Platform, such as your IP address, browser and device type, operating system, general location (for example, city or region), and data from cookies and similar technologies used for security, session management, and analytics.

MLS and Third-Party Data

To power features like MLS auto-completion and market analysis, we obtain data from Multiple Listing Services (MLS) and other property data providers. This may include historical listing data, property attributes, photos, and pricing information. These sources may be outdated or inaccurate, so you are responsible for reviewing and confirming any auto-populated information before submitting or publishing it.

AI Interaction Data

When you interact with AIRE's AI assistants and automated tools, we collect the prompts, questions, and content you provide, as well as AI-generated outputs such as recommendations, summaries, and negotiation guidance. We use this information to deliver and improve our AI features, subject to the safeguards described in this Privacy Policy and any additional disclosures about AI and automated decision-making.

We collect personal data in several ways, depending on how you interact with the AIRE platform and related services. This includes information you provide directly, data collected automatically when you use the Platform, and information we receive from third parties and integrated services.

  • Upload content, including property photos, documents, IDs, and other files related to a listing or transaction.

Automatically When You Use the Platform

When you access or use the Platform, we automatically collect certain information to help operate, secure, and improve our services. This may include:

  • Logs of your activity in the app, such as pages viewed, actions taken, and timestamps.

From Third Parties

  • Multiple Listing Services (MLS) and other property data providers that supply listing data, property attributes, and market information.
  • Payment processors, e-sign providers, and other vendors that support transactions, billing, or document execution.

We use the personal data we collect to operate and improve the AIRE platform, support your real estate transactions, and fulfill our legal obligations. In particular, we use personal data to:

To Provide and Operate the AIRE Platform

We use personal data to create and manage user accounts; enable listing creation and MLS upload; operate dashboards and workflows for listings, applications, and offers; support document management and e-sign workflows; and power transaction management tools that help you move from listing or application to closing.

To Power AI Features and Recommendations

We use the information you provide, along with MLS and market data, to deliver AI-powered pricing analysis, offer and contract guidance, negotiation support, transaction timelines, and recommendations for next steps and relevant professionals. These AI features are designed to help Sellers and Buyers make informed decisions without relying on a traditional real estate agent.

To Communicate with You

We use your contact and transaction information to send service notifications and status updates about listings, applications, and transactions; reminders about time-sensitive steps or documents; and responses to support requests or other inquiries you submit through the Platform.

To Improve, Secure, and Debug the Platform

We use analytics, usage logs, and technical data to monitor performance, detect and investigate bugs, prevent fraud and misuse, and improve existing features or develop new ones. During our beta phase, this may also include using aggregated or de-identified data to evaluate how well new features (such as listing flows, dashboards, and AI tools) are working and where we should focus improvements.

To Comply with Legal and Regulatory Obligations

We process certain personal data to meet real estate and brokerage recordkeeping requirements, support audits and compliance reviews, respond to legal requests and dispute resolution processes, and enforce our Terms & Conditions and other agreements with you.

Marketing and Beta Program Communications (If Applicable)

With your consent where required by law, we may use your contact information and preferences to send information about promotions (such as free listing offers or commission incentives), beta program benefits, surveys, and product updates. You can opt out of marketing communications at any time by following the unsubscribe instructions in those messages or by adjusting your communication preferences where such tools are available in the Platform.

6. Legal Bases for Processing

Where required by applicable data protection laws, AIRE relies on one or more of the following legal bases to process your personal data:

  • Performance of a contract: We process personal data when it is necessary to provide the Platform and related services you request, such as enabling listings, handling applications and offers, managing contracts, and supporting your real estate transactions.
  • Legitimate interests: We process personal data where it is necessary for our legitimate business interests (or those of a third party) and where those interests are not overridden by your rights and interests. This includes improving and securing the Platform, preventing fraud and misuse, and developing new features and services.
  • Compliance with legal obligations: We process personal data when necessary to comply with laws and regulations, including real estate, brokerage, tax, and recordkeeping requirements, and to respond to lawful requests from courts, regulators, or other authorities.
  • Consent: In some cases, we rely on your consent to process personal data, for example for certain optional cookies, marketing communications, or beta program participation where required by law. When we rely on consent, you have the right to withdraw it at any time, which will not affect the lawfulness of processing before your withdrawal.

7. AI and Automated Decision-Making

How AIRE's AI Works in the Platform

AIRE uses artificial intelligence and automated tools to help you list, market, negotiate, and manage real estate transactions. For example, our AI can provide pricing analysis based on comparable properties and market data, suggest terms and edits for offers and contracts, help you draft messages to Buyers or Sellers, highlight important deadlines and tasks, and recommend relevant professionals (such as mortgage, title, or inspection providers). These features are designed to assist you in making informed decisions and managing your own transaction more efficiently.

Nature and Limits of AI Recommendations

AI outputs and recommendations provided through the Platform are for informational and educational purposes only. They do not constitute legal, financial, tax, or other professional advice, and they are not a substitute for advice from licensed professionals who can consider your specific circumstances. While we work to improve the quality of our AI systems, we cannot guarantee that any AI-generated content is accurate, complete, or up to date. You remain responsible for reviewing all AI-generated suggestions, communications, and documents before using them, and for complying with all applicable laws, regulations, and contractual obligations.

Human Review and Your Control Over AI

You are always in control of how you use AIRE's AI tools. You can review, edit, accept, or reject AI-generated content (including suggested pricing, contract language, and message drafts) before it is sent, signed, or otherwise used in a transaction. In many workflows, the Platform will present AI outputs as suggestions or drafts that you can modify or choose not to use at all. We encourage you to carefully review all content before finalizing documents or communications and to seek independent professional advice when needed.

Data Used to Train or Improve AI Systems

When you interact with our AI assistants and automated tools, we may use your prompts, questions, feedback, and AI-generated outputs, together with related usage and technical data, to operate, monitor, and improve our AI features. Where feasible, we use aggregation, de-identification, or other safeguards to reduce the likelihood that this data can be linked back to you or to a specific transaction. We may also work with third-party AI providers who process data on our behalf under contractual restrictions. In some cases, you may have choices about how your data is used for improving AI systems; where such options are available, we will describe them in the Platform or in supplemental notices.

8. MLS, Property Data, and Third-Party Sources

Use of MLS and Property Databases

To power features such as address lookups, listing auto-completion, and market analysis, AIRE connects to Multiple Listing Services (MLS) and other property data providers. Where available, we may use this data to auto-populate fields in your listing or application, suggest pricing ranges, and display historical listing details, property characteristics, photos, and similar information. These external data sources are maintained by third parties and may contain outdated, incomplete, or inaccurate information, so they should be treated as a starting point rather than a definitive record of your property.

Your Responsibilities When Using Auto-Populated Data

You are responsible for carefully reviewing, correcting, and confirming any information that is auto-populated from MLS or other third-party sources before submitting, publishing, or signing documents in the Platform. This includes, for example, verifying property characteristics, square footage, room counts, legal descriptions, disclosures, photos, and pricing information. If no MLS data is available, you may need to manually input all property details. By using the Platform, you agree that AIRE is not responsible for errors or omissions in third-party data and that you will not rely solely on auto-populated information when making decisions or completing legally binding documents.

Sharing with MLS Boards and Listing Syndication Partners

When you submit a listing or otherwise choose to publish property information through the Platform, we may share relevant listing and contact details with MLS organizations, real estate boards, and listing syndication partners so your property can appear on third-party sites (such as major real estate portals) and be marketed to potential buyers. The specific partners and destinations may vary by market and over time, and these third parties have their own terms and privacy policies that govern how they use and display listing data. We share only the information reasonably necessary to support MLS upload, compliance, and syndication, and we may be required to retain or disclose certain listing records under applicable MLS rules and real estate regulations.

9. Sharing and Disclosure of Personal Data

We share personal data only as needed to operate the AIRE platform, support your transactions, comply with legal obligations, and improve our services. When we share personal data, we take steps to limit it to what is reasonably necessary and to require recipients to protect it and use it only for authorized purposes.

Within AIRE and Affiliated Entities

We may share personal data among AIRE's internal teams and any affiliated brokerage or technology entities that help operate the Platform. This includes, for example, sharing information with product, engineering, operations, and support teams so they can assist with your account, troubleshoot issues, improve workflows, and ensure that listings, applications, and transactions are processed correctly. Access to personal data is limited to personnel who have a legitimate business need to know it.

With Service Providers and Vendors

We engage trusted service providers who process personal data on our behalf to help deliver the Platform. These providers may include hosting and cloud infrastructure providers, analytics tools, email and messaging vendors, customer support tools, electronic signature providers, MLS integration partners, and secure document storage services. We require these vendors to use personal data only as necessary to provide their services to us and to implement appropriate security and confidentiality protections.

With Real Estate Professionals and Transaction Counterparties

As part of real estate listings, applications, offers, and closings, we may share relevant personal data with buyers, sellers, and their representatives or advisors, as well as other professionals involved in the transaction (such as title or escrow companies, mortgage providers, inspectors, and insurance providers). This sharing is necessary to evaluate offers, negotiate and finalize contracts, coordinate inspections and closings, and complete other steps in the transaction lifecycle. In general, we apply the following retention practices for major categories of data processed through the Platform:

  • Account data: Basic account and identity information (such as your name, contact details, and login credentials) is typically kept for as long as your account is active and for a reasonable period afterward where necessary for recordkeeping, dispute resolution, or to comply with legal obligations.
  • Listing and transaction records: Information related to listings, offers, contracts, and closings (including documents and signatures) may be retained for extended periods required by real estate, brokerage, tax, and financial recordkeeping laws, as well as applicable limitation periods for potential claims.
  • Communication logs: Messages and communication logs exchanged through the Platform between Buyers, Sellers, and other participants are retained as part of the transaction record and for a period necessary to support audits, dispute resolution, compliance reviews, and platform security.
  • AI interaction data: Prompts, inputs, and AI-generated outputs used to power AIRE's AI assistants are retained for periods needed to provide the service, improve and monitor AI features (as described in this Privacy Policy), and maintain security and integrity of the Platform, after which they may be deleted, aggregated, or de-identified.

How We Determine Retention Periods

When deciding how long to keep personal data, we consider factors such as:

  • Legal and regulatory requirements for real estate and brokerage recordkeeping.
  • Applicable statutes of limitation and contractual requirements related to potential claims or audits.
  • The nature of the data and whether it is needed to maintain accurate business and transaction records or to improve and secure the Platform.
  • Technical constraints, backup and archival practices, and the need to protect the Platform against fraud, abuse, and security incidents.

Data Deletion and Anonymization

When personal data is no longer needed for the purposes described in this Privacy Policy, we will either delete it or take steps to irreversibly de-identify it, unless we are required by law or have a legitimate business reason to retain it for longer. While no online service can guarantee absolute security, we aim to maintain security measures that are appropriate to the nature of the data and the risks associated with our AI-powered real estate workflows.

Your Responsibilities for Account Security

You also play an important role in keeping your information secure. You are responsible for maintaining the confidentiality of your account credentials, choosing strong and unique passwords, and limiting access to the devices and browsers you use to access the Platform. If you download or export documents (such as listing packets, contracts, or application files) from the Platform, you are responsible for storing, sharing, and disposing of those documents in a secure manner.

You should notify us promptly if you suspect any unauthorized access to your account or believe your credentials have been compromised. In addition, we recommend that you avoid reusing passwords across different services and that you sign out of shared devices when you are finished using the Platform.

Incident Response and Notifications

AIRE maintains processes to detect, investigate, and respond to potential security incidents affecting the Platform. If we become aware of a security incident that involves your personal data, we will take steps to contain and remediate the issue and, where required by applicable law, notify you and/or relevant authorities within the time periods prescribed by those laws. When appropriate, we may also provide you with information about steps you can take to help protect yourself and your data.

13. International Data Transfers (If Applicable)

Where Your Data Is Processed and Stored

AIRE currently operates primarily from the United States, and the Platform is hosted on cloud infrastructure located in the U.S. This means that personal data collected through the Platform is generally processed and stored in the United States, even if you access the Platform from outside the U.S. In some cases, our service providers or transaction counterparties (such as real estate professionals, title or escrow companies, or other vendors) may also be located in or access data from jurisdictions other than where you reside.

You can opt out of receiving marketing emails or similar promotional communications from AIRE at any time by following the unsubscribe instructions included in those messages or, where available, by adjusting your communication preferences in the Platform. Even if you opt out of marketing, we may still send you non-promotional messages related to your account, listings, applications, transactions, or important updates about the Platform.

How to Exercise Your Rights

To exercise any of the rights described in this section, you can contact us at support@airebroker.casa or through any in-product tools we provide for managing privacy or communication preferences. We may ask you for information needed to verify your identity and to help us locate your records. Subject to applicable law, we will respond to your request within a reasonable time (for example, within 30 or 45 days, plus any permitted extensions) and will explain any reasons why we cannot fully comply with your request where an exception applies.

15. Children's Privacy

Intended Audience of the Platform

The AIRE platform, including our AI-powered tools, listing workflows, and transaction dashboards, is designed for use by adults who are involved in real estate transactions, such as Sellers, Buyers, and related professionals. It is not directed to children, and we do not market the Platform to individuals under the age of 18 or otherwise below the age of majority in their jurisdiction.

Data Relating to Minors and Age Restrictions

We do not knowingly collect personal data directly from children under 18 through the Platform. If you are under 18 (or the applicable age of majority where you live), you should not create an account, submit listings or applications, or otherwise use the Platform without the involvement of a parent or legal guardian. In limited circumstances, information about minors (for example, household members or occupants) may be included in transaction documents or applications provided by an adult user; when this occurs, we treat that information as part of the broader transaction record and protect it in accordance with this Privacy Policy.

16. Beta Program and Experimental Features

Beta Status of the Platform

The AIRE platform is currently offered in a beta phase and is under active development. This means that features, workflows, and integrations (including listing flows, dashboards, AI tools, and promotional programs such as beta launch specials) may change, be added, or be removed over time. Because the platform is still being refined, there is an increased likelihood of bugs, interruptions, or temporary changes to how certain features operate or how data is collected and displayed. However, even during beta, we aim to handle personal data in a manner consistent with this Privacy Policy and applicable law.

Additional Data Collected During Beta

To improve the Platform during beta, we may collect additional feedback, usage information, logs, and diagnostic data beyond what is strictly necessary to provide core functionality. We strongly encourage you to consult with your own independent legal, financial, tax, and real estate professionals before entering into binding agreements, making significant financial decisions, or relying on AI-powered guidance in the Platform.
